लॉकडाऊन काळात पोलिसांकडून होत असलेल्या नागरी अधिकार हनन प्रकरणाची हायकोर्टाकडून गंभीर दखल
लॉकडाऊन काळात मॉर्निंग वॉक करणाऱ्या नागरिकांना शिक्षा करण्याचे प्रकार दिवसेंदिवस घडत आहेत. अशाच एका प्रकारात शिक्षा भोगलेल्या एका जेष्ठ नागरिकाने नागपूर खंडपीठात दाखल केलेल्या जनहित याचिकेवर निकाल देताना न्यायालयाने पोलिसांना शिक्षा देण्याचा अधिकार नसल्याचे खडे बोल सुनावत, अशा प्रकारच्या घटना भविष्यात घडल्यास त्याला वरिष्ठ पोलीस अधिकाऱ्यांना जबाबदार धरले जाईल असा इशाराही नुकताच (दिनांक ५ मे) दिला आहे.

संदीप मधू नायर विरुध्द सरकार (जनहित याचिका क्रमांक ३५/२०२०) या प्रकरणात उच्च न्यायालयाचे न्यायमूर्ती रोहित बी. देव यांनी हा महत्वपूर्ण आदेश दिला आहे. या प्रकरणात याचिकाकर्त्यांच्या बाजूने अनिल कमले यांनी बाजू मांडली. तर सरकार पक्षातर्फे अतिरिक्त सरकारी अभियोक्ता श्रीमती के. एस. जोशी यांनी काम पाहिले. याचिकाकर्त्याच्या म्हणण्यानुसार, कोविड-१९ चा सामना करीत असताना पोलिसांकडून संचारबंदी आदेशाचे कठोर पालन करीत असताना काही पोलीस कर्मचारी मात्र मानवाधिकाराचे उल्लंघन होईल असे वर्तन करीत आहेत. मॉर्निंग वॉकसाठी जाणाऱ्या, ज्यामध्ये जेष्ठ नागरिकांचाही मोठ्या प्रमाणात समावेश असतो, अशा लोकांना पोलीस ताब्यात घेतात आणि त्यांच्या हातात ते देशाचे, समाजाचे शत्रू आदी मजकूर असलेले बॅनर देऊन त्यांना अपमानित करतात. आणि त्यांचे फोटो वर्तमानपत्रात प्रसिद्ध करून त्यांना अपमानित करतात, भारतीय राज्यघटनेने कलम २१ मध्ये दिलेल्या जीवन जगण्याच्या अधिकाराची पायमल्ली करतात, त्यांचे मूलभूत अधिकार हिरावून घेतात अशी तक्रार याचिकाकर्त्याने केली होती. असले प्रकार वगळता पोलिसांचे काम कौतुकास पात्रच असले तरी या प्रकारांमुळे पोलीसांची बदनामी होत असल्याचेही याचिकेत नमूद केले. याबाबत याचिकाकर्त्याने न्यायालयात सबळ पुरावे सुद्धा दाखल केले. यावर सरकारी अभियोक्ता यांनी पोलिस आयुक्त श्री उपाध्ये आणि सह-पोलिस आयुक्त श्री रविंद्र कदम यांनी त्यांना दिलेल्या माहितीनुसार, असले प्रकार लॉकडाऊनच्या पहिल्या टप्प्यात घडले असून वर्तमानपत्रात छापण्यात आलेली अपमानजनक छायाचित्रे मात्र पोलिसांनी प्रसिद्ध केली नाहीत असे सांगितले. यावेळी सरकारी अभियोक्त्यांनी मात्र प्रसिद्ध झालेली छायाचित्रे पोलिसांनीच काढली की नाही हे स्पष्ट केले नाही. यावर उच्च न्यायालयाने मानवी हक्कांच्या पायमल्लीबाबत तीव्र नाराजी व्यक्त करीत, ज्या पोलिसांनी असले वर्तन केले, मानवी सन्मानाचे उल्लंघन केले, त्यांनी समाजाप्रती सुसंस्कृतपणा दाखवून समाजाशी जिवंतपणा दाखविण्याची अपेक्षा आहे, असे नमूद केले. अतिअसामान्य परिस्थितीचा मुकाबला करण्यासाठी पोलिसांना कायद्यानेच पुरेसे अधिकार दिले आहेत. परंतु हे करताना मानवी प्रतिष्ठा आणि घटनात्मक अधिकार यांचे मात्र पोलीस हनन करू शकत नाहीत. असल्या घटना भविष्यात घडणार नाहीत, याबाबत पोलिसांनी काळजी घ्यावी असे सांगतानाच न्यायालयाने लॉकडाऊन काळात कोणालाही नियमबाह्य शिक्षा पोलिसांकडून होणार नाही याची नोंद घेण्याचे आदेश दिले. आणि भविष्यात अशा प्रकारची एकही घटना समोर आल्यास त्या ठिकाणच्या वरिष्ठ पोलीस अधिकाऱ्यांना जबाबदार धरण्याचे आदेश पोलीस आयुक्तांना दिले. याबाबत न्यायालयाने राज्यशासनाला नोटीसही बजावली आहे. एखाद्या आरोपीला किंवा कायद्याचे उल्लंघन करणाऱ्यांना स्वतःच शिक्षा देण्याचा अधिकार पोलिसांना कायद्याने दिला नाही, तर त्यासाठी न्यायालये सक्षम असल्याचे किंवा तसला अधिकार केवळ आणि केवळ न्यालयालयानाच असल्याचे खंडपीठाने स्पष्ट केले आहे. त्यामुळे भविष्यात असले प्रकार घडणार नाहीत याची पोलिसांना गंभीर दखल घ्यावी लागणार आहे. तसेच विनाकारण मर्दुमकी गाजवणाऱ्या पोलिसानांही चाप बसणार आहे.

1. This Public Interest Litigation brings to the fore an extremely disturbing and distressing facet of the enforcement of the lockdown directives.
2. The petitioner contends that in an anxiety to strictly enforce the lockdown directives issued to combat the Covid Virus, certain personnel of the police force are guilty of gross violation of human rights. The petitioner contends that while the police force, by and large, has risen to the occasion and is discharging its duties in an exemplary manner, the instances highlighted in the petition is a blot on
the otherwise laudable performance of the police machinery.
3. The petitioner contends that persons who allegedly violated the lockdown directives, including senior citizens on morning walks, are subjected to inhuman indignities. The alleged violators are photographed holding placards declaring that the violator is an enemy of the
nation, the society, the family and humanity since he is a law breaker.
4. It is further submitted that photographs of the lockdown violators, which include elderly citizens and respected professionals, have been published in prominent newspapers and have gone viral on social media.
5. The petitioner would submit that while police are entitled, and indeed bound to, take all possible measures within the four corners of law, as are necessary to enforce the lockdown, making a humiliating spectacle of the violators is a serious infringement of human rights and the constitutional right guaranteed under Article 21.
6. In view of the extremely disturbing averments in the petition, before issuing notice, I consider it appropriate to request the learned Addl. Government Pleader Smt. K.S. Joshi to ascertain whether the instances which are highlighted have as a fact occurred. The learned Addl. Govt. Pleader states that she has received instructions from the Commissioner of Police Shri Upadhye and the Joint Commissioner of Police Shri Ravindra Kadam and she is in a position to state on instructions that while certain instances did occur in the first phase of lockdown, the humiliating photographs have not been published by the police. However, the learned Addl. Govt. Pleader Smt. K.S. Joshi is not in a position to make a statement, at this stage, whether the photographs are taken by police personnel and assures the Court that such a statement shall be made on the next date of hearing.
7. I have come across several news reports highlighting the unusual and humiliating punishments which are meted out by police personnel under the garb of enforcing the lockdown directives. This Court has no reason to suspect the intent. However, the end does not
necessarily justify the means. The police personnel who have indulged in a blatant violation of human dignity were expected to be alive to our society being a civilized society governed by the rule of law. While extraordinary situations may call for extraordinary measures, the measures must have the sanction of law. Human dignity and rights cannot be sacrificed at the alter of extraordinary situations nor can the constitutional right to a dignified life be hostage to supposed intentions. This Court would request the Police Commissioner to sentitivise the personnel under his command to ensure that such sordid incidents do not occur.
8. This Court directs that no extra legal measures or punishments shall be taken recourse to while enforcing the lockdown. The police machinery has sufficient power under the provisions of law which would enable strict enforcement of the lockdown directives. While this Court trusts that the top echelons of the police machinery shall ensure that there shall be no further violation of human rights while enforcing the lockdown, should a single such incident be noticed, this Court expects the Police Commissioner to hold the senior officer within whose jurisdiction the incident has occurred, accountable.
9. Issue notice to the respondents, returnable on 21.5.2020.

का म्हणून पोलिसांना विरोध करारात पब्लिकला लॉक डाऊन काय असतो ते तरी माहिती आहेत काय लॉक डाऊनचे नियम जर पब्लिक मोडत असेल तर त्यांना शिक्षा व्हायलाच हवी. I सपोर्ट पोलीस.
