Lawyers must stand up against acts maligning judges: BCI, TNAA condemn Andhra CM's letter against Justice NV Ramana

The Bar Council of India (BCI) has released a press note condemning the "reprehensible move" of Andhra Pradesh Chief Minister YS Jagan Mohan Reddy targeting Justice NV Ramana, who is next in line to be the Chief Justice of India.

The BCI issued the press release in view of the media reports that Reddy had addressed a letter to the CJI levelling serious allegations against Justice Ramana.

The Tamil Nadu Advocates' Association (TNAA) has also released a statement expressing its anguish over the move to scandalise the judiciary which is termed as being politically motivated to gain clout and settle scores.

In the BCI statement, signed off by its Chairman Manan Kumar Mishra, it is stated,

"The Council has always stood to protect the dignity and decorum of the Institution. The lawyers of the country have always stood behind the judges whenever any attempt to scandalize the Institution has been made, and the legal fraternity of the country will never tolerate any such evil design of anybody to malign the system."

The BCI has equated the act of releasing the letter to the media as a "clear conspiracy to malign and scandalise judges" and "a move to shake the confidence of the public in the institution of Judiciary".

The BCI has proclaimed that Reddy is only tarnishing his own image by pressurizing a judge.

"Justice NV Ramana was dealing in a Public Interest Litigation for decriminalizing politics", the BCI points out, musing that this could be a reason for the Judge being targeted.

The BCI also drew attention to the fact that since judges could not counter such allegations in public because of "judicial discipline", the responsibility falls upon the Bar and citizens of the country to uphold the dignity of the institution.

The BCI has called upon lawyers to step up and defeat the hidden agendas which disrupt smooth functioning of courts and the administration of justice.

Another statement signed off by TNAA President, S Prabakaran asserts that the time has come to curb attempts to write such scathing letters to damage the reputation of the judicial institution. It adds,

"The letter of Mr Jagan Reddy in the guise of politicising Judiciary and portray a false image to the public tries to rob the public of their common sense and covertly attempts to cover up the real issue of his own credibility amongst his own people and in a last ditch attempt to save his shred of dignity immediately points the blame at the judiciary."

On Wednesday, the Delhi High Court Bar Association also passed a resolution condemning the allegations made by the Andhra Pradesh Chief Minister.

Further, a petition has been filed in the Supreme Court seeking directions to restrain Reddy from making public statements or holding press conferences to malign the “august institution of the Supreme Court” and its judges.
