Aurangabad Bench Of Bombay HC Orders State To Make Public Aware Of The Current Status of Covid-19 and Steps Taken

A bench of the Aurangabad High Court has ordered to inform the citizens on a daily basis about the measures taken by the government and the current situation regarding Covid-19, taking note of the news published in various newspapers. According to the Supreme Court order, strict curfew will now be imposed in restricted areas and strict action will be taken against officials and employees who neglect their duties.
In Aurangabad district and especially in the city, various newspapers had published news expressing their displeasure over the various measures and relief work being carried out by government officials and employees in the context of Covid-19-Corona disease. The Aurangabad bench of the Bombay High Court had taken cognizance of the news and filed a criminal public interest litigation. The petition is scheduled to be heard on July 3.
In this hearing, the High Court has given important orders to the state government regarding Covid-19 disease. According to the directive, officers and employees appointed to deal with corona disease should be subjected to criminal and disciplinary action if they do not return to work. In addition, representatives of the District Collector, Superintendent of Police, Government Hospitals and Municipal Administration should hold daily press conferences to inform the public about the measures taken by the administration regarding corona disease and its current status. Also the officials themselves should hold a press conference at least once a week, the High Court has expressed strong displeasure over the restricted area and has directed strict enforcement in the restricted areas.
Whether the rules are followed in this area or not, why the employees are present on duty? It has been instructed to ensure this, to prepare the lock book of the employees. Hingoli District Collector Ruchesh Jayavanshi has also issued such an order and action will be taken against him for violating Section 188 of the Indian Penal Code as a punishable offense.
In the same manner, action will be taken against them under the Disaster Management Act, Infectious Diseases Prevention Act, Measures Rules-2020. Therefore, the administration will take a tough stance in the coming corona measures; In addition, the citizens will also get daily information regarding the measures taken by the administration and the current situation. This will reduce the anger and resentment among the citizens against the administration and will help in creating harmony between the citizens and the administration.
औरंगाबाद येथील उच्च न्यायालयाच्या खंडपीठाने विविध वर्तमानपत्रांमध्ये प्रसिद्ध झालेल्या बातम्यांची दखल घेऊन कोविड-१९ संदर्भात शासनाने केलेल्या उपाययोजना आणि सद्यस्थिती याबद्दल नागरिकांना दररोज माहिती देण्याचे आदेश दिले आहेत. त्याचबरोबर सर्वोच्च न्यायालयाने दिलेल्या आदेशानुसार आता प्रतिबंधित क्षेत्रांमध्ये कडक संचारबंदी करण्यात येणार असून याकामी कर्तव्यात हलगर्जी करणाऱ्या अधिकारी कर्मचार्यांवर सुद्धा कठोर कारवाई करण्यात येणार आहे.
औरंगाबाद जिल्ह्यात आणि विशेषतः शहरात विविध वर्तमानपत्रांमध्ये सरकारी अधिकारी आणि कर्मचाऱ्यांकडून कोविड-१९ -कोरोना रोगा संदर्भात करण्यात येणाऱ्या विविध उपाययोजना आणि मदत कार्याबद्दल तीव्र नाराजी व्यक्त करणाऱ्या बातम्या प्रसिद्ध झाल्या होत्या. या बातम्यांची गंभीर दखल घेऊन मुंबई उच्च न्यायालयाच्या औरंगाबाद खंडपीठाने स्वतः दखल घेऊन फौजदारी जनहित याचिका दाखल करून घेतली होती. या याचिकेची ३ जुलै रोजी अंतिम सुनावणी झाली आहे.
या सुनावणीत उच्च न्यायालयाने राज्य सरकारला कोविड-१९ रोगा संदर्भात महत्वपूर्ण आदेश आदेश दिले आहेत. या निर्देशानुसार कोरोना रोगासंदर्भात उपाययोजना करण्यासाठी नियुक्त करण्यात आलेले अधिकारी, कर्मचारी हे आपल्या कामावर रुजू झालेले नसल्यास त्यांच्यावर फौजदारी आणि शिस्तभंगाची कारवाई करण्यात यावी. त्याचबरोबर कोरोना रोगासंदर्भात प्रशासनाच्यावतीने करण्यात आलेल्या उपाय योजना आणि त्याची सद्यस्थिती याची सर्व जनतेला माहिती होण्यासाठी जिल्हाधिकारी, पोलिस अधीक्षक, शासकीय रुग्णालय व पालिका प्रशासन यांच्या प्रतिनिधींनी दैनंदिन पत्रकार परिषद घेऊन नागरिकांना माहिती द्यावी. तसेच या अधिकाऱ्यांनी स्वतः आठवड्यातून किमान एकदा पत्रकार परिषद घ्यावी, प्रतिबंधित क्षेत्राबद्दल उच्च न्यायालयाने तीव्र नाराजी व्यक्त केली असून प्रतिबंधित क्षेत्रांमध्ये कठोर अंमलबजावणी करण्याच्या सूचना केल्या आहेत.
या क्षेत्रात नियमांचे पालन होते की नाही कर्मचारी कर्तव्यावर हजर राहतात का नाही? याची खातरजमा करावी, कर्मचाऱ्यांचे लॉकबुक तयार करावे आदी निर्देश दिले आहेत. (Help Desk In The Private Hospitals Be Installed and Officers Be Appointed On the Same) त्याचबरोबर कोविड-१९ रुग्णांवर उपचारासाठी निश्चित करण्यात आलेल्या खाजगी रुग्णालयांमध्ये 'हेल्प डेस्क' तयार करून त्याठिकाणी ताबडतोब शासकीय अधिकारी नियुक्त करण्यात यावा असे आदेशही उच्च न्यायालयाने दिले आहेत. उच्च न्यायालयाने दिलेल्या आदेश निर्देशांची अंमलबजावणी करण्याचे अधिकार जिल्हा स्तरावरून जिल्हाधिकाऱ्यांना आहेत. याबाबत राज्यभरातील जिल्हाधिकाऱ्यांनी त्याठिकाणी तसे आदेश निर्गमित केले आहेत. हिंगोली जिल्ह्यात जिल्हाधिकारी रुचेश जयवंशी यांनी सुद्धा असे आदेश निर्गमित केले असून या आदेशांची पायमल्ली करणारे आदेश न पाळणाऱ्यावर भारतीय दंड विधानाच्या कलम १८८ शिक्षापात्र अपराध केला असल्याचे मानले जाऊन त्याच्यावर कारवाई करण्यात येणार आहे.
त्याच पद्धतीने आपत्ती व्यवस्थापन कायदा, साथरोग प्रतिबंध कायदा, उपाययोजना नियम-२०२० या कायद्यानुसार सुद्धा त्यांच्यावर कारवाई करण्यात येणार आहे. त्यामुळे येणाऱ्या काळात कोरोना उपाययोजना संदर्भात प्रशासन कठोर भूमिका घेणार आहेच; शिवाय नागरिकांना प्रशासनाने केलेल्या उपाय योजना आणि सद्यस्थिती संदर्भात दैनंदिन माहिती सुद्धा मिळणार आहे. यामुळे प्रशासनाविरुद्ध नागरिकांमध्ये निर्माण झालेला रोष, नाराजी कमी होऊन नागरिक आणि प्रशासन यांच्यामध्ये सुसंवाद निर्माण होण्यास मदत होणार आहे.
