Dastane vs. Dastane, 1975 Section 10(i) (b),13 (i) (a) The Hindu Marriage Act, 1955.


     Dr. N.G. Dastane, the petitioner in the instant case married S. Dastane in 1956 and 3 children were born to them. The husband filed a petition for annulment of the marriage on the ground of cruelty under Section 10(i) (b) and Section 13 (i) (a) of the Hindu Marriage Act, 1955.  The allegations against the wife were, she was threatening to put an end to her own life (Suicide), to set fire to the house to ruin his family; insulting and abusing him and his parents in the presence of the guests and neighbours, threatening to urn the book written by his father; rubbing chilly powder on the infant child, beating the child suffering from high fever mercilessly etc.  The husband proved her trouble making behavior and indifferent attitude.
      
     The Bombay High court annulled the marriage on the ground of wife’s cruelty. On appeal, the Supreme Court reversed the decision of the High Court and dismissed the petition.
